DECISION ' These 13 appellants are working in various categories as mechanics in Pakistan Railways. By mistake they were allowed Pay Scale No, 9 but on discovering the mistake they were granted Pay Scale No,
8. Under the Circular BPS-9 was to be allowed on fulfillment of four conditions:--
(1) Twenty years minimum length of service.
(2) Passing of Skilled Trade Test;
(3) Availability of vacancy; and
(4) Service for 8 years in skilled trade;
2. The applicants have not shown that all the conditions are applicable in their cases though they all have 20 years service to their credit. Under the Circular, BPS-9 is prescribed for the Mistry while the appellants are designated Work-Mistries, Block Mistries etc. The grievance petition of the appellants was, therefore, dismissed by the VIlth Labour Court Sukkur. Against the order of dismissal they have preferred this appeal.
3. Mr. Fasahat Hussain Rizvi for the appellants is absent. Only Muhammad Khalid is present. The remaining 12 appellants are also not present. It has not been shown how they are entitled to BPS-9 when they do not answer to all the requirements under the rules. There is no substance in this Joint Appeal, which is accordingly dismissed and the order of the Labour Court is maintained.
