DECISION ' This is a Revision Application against the order of Fifth Sindh Labour Court, Karachi dismissing an application under section 51 of I.R.O. For recovery of Rs,1,10,915.61 back benefits as arrears of Land Revenue. This application or appeal before the Labour Court was filed against the appellate order of learned Third Sindh Labour Court, Karachi denying the claim of the present applicant on merits also. The learned Fifth Sindh Labour Court found that the appeal presented to it was not maintainable and the Court had no jurisdiction to entertain it. The application was accordingly dismissed by the Fifth Sindh Labour Court, Karachi. Against this dismissal the present Review Application has been moved in this Tribunal.

2. Since the Labour Court No, V could not hear appeal. Review or Revision against the decision of Labour Court No, III under any law and found the application as being not maintainable this Tribunal cannot hold that the order of Labour Court No, V was illegal, improper or incorrect.

3. Even the order passed by the Authority under the Payment of Wages Act dismissing the claim of the applicant has not been filed alongwith this Revision Application so that the merits of the case cannot be ascertained.
