DECISION ' The appellant has challenged the order of Fourth Sindh Labour Court, Karachi whereby the petition of the respondent for declaration of his status as permanent worker was allowed.
2. Respondent Muhammad Saleem was employed as a driver with the Steel Mills from 2-2-1980. As he would become permanent after a period of 90 days because he was employed in a permanent post the Steel Mills used to employ him every time for half day less than 90 days. In this way he has worked up to the time he made petition for declaration of his status. Obviously this procedure is being adopted by the Steel Mills to circumvent the labour laws so that he should not claim privileges of permanent worker.
3. The learned Labour Court found that the petitioner had become a permanent worker under the I.R.O. And the Standing Orders Ordinance, 1968 and the petition was, therefore, allowed.

It has been argued by Mr. Zahid Hamid, Advocate for the Steel Mills that the respondent had also applied for arrears of pay and these could not be granted because they had become time-barred but the respondent was being paid his salary every month and limitation cannot be claimed by the Steel Mills as every part payment of salary revived the period of limitation.
