DECISION ' Appellant Khalil Ahmed is present in person. His Advocate Mr. Muhammad Saleh Memon has not appeared or has sent any application for adjournment. The Advocate for P.IA. Is also absent.
2. This appeal arises from the order of Fourth Sindh Labour Court, Karachi whereby the petition of the appellant under section 25-A of the I.R.O. Was dismissed.
3. The facts in brief are that the appellant was working as Office Attendant in the Finance Department of P.IA. He was allowed leave of absence from 11-3-1990 to 17-3-1990 but he failed to resume duty or applied for extension of leave. He was given a show-cause notice on 5-4-1990 but there was no response. He continued to remain absent until end of May, 1990 when he reported for duty. A domestic enquiry was held against him for misconduct. He was then dismissed from service.
4. The learned Labour Court found that the appellant had not established service of grievance notice on the P.IA. No evidence of service was available on record of the Trial Court. He had absented himself without leave from 18-3-1990 till 30th May, 1990 for 2-1/2 months without any intimation.
5. The contention of the appellant is that he could not attend office on account of illness of his wife but no such intimation was sent to the P.I.A. Thus, the appellant has been rightly dismissed and his grievance petition has been rejected on the ground of non-service of grievance notice as well as on merits..! Can find no ground for interference with the order of the lower Court. The order of the Labour Court is accordingly maintained and the appeal is dismissed.
