' The petitioners in this case are Senior Calligraphists, placed in Grade-III. They prayed through their applications that keeping in view the nature of their duties, they may be designated and called Art Sub-Editors.
2. According to Schedule I of 5th Wage Board Award, Item 3 comprised of the following categories: "Assistant Head Katib, Assistant Head-Line Writer, Senior Calligrapher, Assistant Art Editor, Art Sub- Editor."
' In other words all the aforesaid persons fall in one category.
2. The grievance of the petitioners is that they are being called "Copy Paster". They are admittedly Senior Calligraphers and to describing them as a Copy Paster is to degrade them. Copy Paster has not been defined, anywhere in the various Awards. This appears to be an innovation of the Management. It is not proper for the Management to categorise a Senior Calligraphist/Assistant Art Editor/Art Sub-Editor as a "Copy Paster".
3. It is the case of the petitioners that a person becomes a Calligraphist then he is promoted to the rank of a Senior Calligraphist and thereafter he becomes Assistant Art Editor or Art Sub-Editor. In support of this contention, the petitioner has placed on the file a photocopy of an office order of Daily Mashriq in respect of one Mr. Karamat Ali, who was in the beginning designated as Junior Calligraphist. After some time he becomes Senior Art Sub-Editor. Similarly a photocopy of office order of Mr. Ghulam Ahmad has also been placed on the record. He stated as a Senior Calligraphist, then he was promoted as Art Sub-Editor and later an Art Editor. He is currently Chief Art Editor in Daily Khabarain, Islamabad. These Office Orders are being relied upon by the petitioner in order to show that this is a common practice in the newspaper industry that a Calligraphist becomes Assistant Art Editor, Art Sub-Editor and finally Art Editor. He also referred para.50 of the 2nd Wage Board Award, which reads as under:-- "50. Some adjustments have, however, been made in the case of Calligraphist in view of the change that has taken place in the nature of their duties and the importance that their profession has gained within the newspaper industry. In some of the papers the Senior Calligraphists have already been placed very high. To accommodate such senior persons, higher posts with the designation of Khatat-e-Aala in Grade-I and Head Calligraphist, Art Editor, Display Calligraphist, Head Line Writer in Grade-II, have been proposed by the Wage Adviser. I agree that in a newspaper, where the employment of Calligraphist of higher skill is considered desirable, the persons so employed should be placed in the grades proposed by the Wage Adviser."
6. Mr. Hamid Ali, Accounts Officer, appearing for the Management vehemently opposed the contentions of the petitioner. He submitted that as the Art Editor has not been defined anywhere in the Awards, the Management was not bound to give the petitioner a status of an Art Sub-Editor. It was not denied by him that there was no change of grade or salary involved in the case. He placed on record a photocopy and the comments of Mr. Abdul Hafeez Farooqui, Head Katib, Daily Jang, Rawalpindi with regard to the duties of the petitioner and others.

No doubt Art Editor or Art Sub-Editor has not been defined in the Wage Board Awards but from the aforementioned office orders read with para.50 of 2nd Wage Board Award reproduced above, and para.74 of the 5th Wage Board Award, which reads as:-- "Subject to the provisions of fitment formula laid down by to decision, the principal duties performed by an employee in a newspaper establishment shall determine the post held by him in accordance the functional definitions, notwithstanding the fact that he is desig, differently in the newspaper establishment. No casual or occa work entrusted to him or any casual combination of duties shall a' entitlement to wages as prescribed by this decision."
' It is apparent that the Assistant Art Editor and Art Sub-Editor would the various categories of Calligraphist. I am fortified in this classification of various grades given in Schedule I of the 5th of Award under item 3. I have also held that copy pasting is the annoy not an Management. It is not defined in any of the awards and that held that endearing term and that it tends to degrade a Senior Calligraphist called a the petitioner who is admittedly a Senior Calligraphist, would "Copy Paster". He may be considered for being called as Assistant Art Editor or Art Sub-Editor.
8. It is further submitted by the petitioner that if he is designated as Assistant Art Editor or Art Sub- Editor, there is no change in the grade and there is no increase in the salary. It is the opinion of this Tribunal that if the change of designation does not involve any change of grade or increase in the salary then Management, in all fairness, should designate them in keeping with the nature of the work of the employees as per para.74 of the 5th Wage Board Award, referred to above.

It appears that the principal duties performed by the petitioner in this case involves the arranging of headlines of newspaper and arranging news in such a manner as to make the newspaper pleasant to look it. In other words it is duty of the petitioner to improve the get-up or the whole make-up of the newspaper. Naturally the get-up of the newspaper is the joint venture of the Calligraphist and the Artist or the Art Editor who join hands to arrange news and its headlines in such a way that the newspaper looks pleasant and eye-catching. A photocopy of the note of Mr. Farooq Azam, former Resident Editor of Daily Jang, Islamabad brings out these facts in his letter.

Although, there is no definition of Art Editor/Art Sub-Editor/Assistant Art Editor anywhere in any of the Awards, but it is apparent that considering the nature of functions in bringing out the newspaper, one can say that the duty of an Art Sub-Editor is to act with the News Editor and the Calligraphist and to arrange news and their headlines in such a manner that the newspaper presents a pleasant look which would be eye-catching for the readers and general public.
11. In view of the above discussion, the Management is directed to designate the petitioners as Art Sub-Editor, considering the principal duties which are being performed by them in the newspaper.
