ORDER GHULAM AHMAD ASIF JAN, J.- Pursuant to a report lodged by one Ghulam Rasul, a case was registered against Amjad Ali petition alongwith three others vide FIR No. JS on 6.3.1994 at Police Station Raya Khas, District Narowal, under Sections 324/394,344, P.P.C.
2. The allegation against the petitioner is that while armed with a carbine, he fired at and injured one Haji Muhammad Yusuf (PW). There are two injuries on the person of Haji Muhammad Yusuf, both caustified by a fire-arm.
3. Admittedly Haji Muhammad Yusuf (PW) was also armed with pistol and seems to have used the same because Muhammad Afzal co-accused,. Who is the real brother of Amjad Ali petitioner also received fire-arm injuries.
4. As to who was the aggressor is yet to be determined at the trial, which should commence in the near future, as the challan has already been submitted in the Court. Prima fade the case against the petitioner is of further inquiry within the meaning of Sections 497(2), Cr.P.C. He is, therefore, granted bail provided he furnishes bail bond in the sum of Rs. 50,000/- with one surety in the like amount to the satisfaction of the trial Court.
