ORDER MIAN GHULAM AHMAD, J.- Petitioners having involvement in a case under sections 137-A(i). F(v) 34, PPC, registered at P.S. Pi plan, Distt. Mianwali, have approached this Court for their release on bail, after having been unsuccessful in securing the same relief from the lower Courts, the learned Sessions Judge, Mianwali having dismissed their hail petition on 16.6.1994, and the learned Magistrate having turned down their request earlier on 24.1.1994.

2. I need not narrate details, how the alleged incident occurred and what was its background. Allah Bakhsh and Ghulam Rasool PWs had been injured in the occurrence. Ghulam Hussan accused, who was armed with a hatchet, and caused injuries to Allah Bakhsh and the other two accused, Allah Bakhsh and Ibrahim, had been responsible for the injuries, which Ghulam Rasool received in the course of occurrence. They had allegedly made use of 'vaholis'. The offences which the accused face are, however, not covered by the prohibitory clause of section 497, Cr.P.C. The accused, who are all brothers, have been behind the bars over several months and their further detention is not going to serve any useful purpose of the prosecution. The incarceration they have already undergone is considered to be sufficient at the pre-trial stage. They will get their due on conviction in trial. For the present, they do not seem to be dis-untilled to the concession of bail, even if their assertion that they have been falsely involved in the criminal case is dis-believed. The petition is accepted. The accused are ordered to be enlarged, on each one of them furnishing a bail bond in the sum of Rs. 15,000/-, with one surety each in the like amount, to the satisfaction of A.C/Duty Magistrate Pi plan, Distt. Mianwali.
