ORDER S.M. ZUBAIR, J.- Fateh Muhammad filed Writ Petition No. 4565 of 1994, for the recovery of Adalat Khan detenu from the illegal detention of Incharge Police Post Khunda Morr. On 23-4-1994, a bailiff of this Court was deputed. He recovered Adalat Khan and produced him before this Court on 24-4-1994. After recording the statement of Incharge Police Post Khunda Morr, it came to light that entry regarding the arrest of Adalat Khan in Police Station Mangtanwala in case FIR No. 329/93, dated 15-11-1993, under sections 457/380 PPC., was manoeuvred after the raid by the bailiff. Resultantly, the detenu Adalat Khan was admitted to ad interim bail rill 3-5- 1994, with the direction to file a formal application of bail. The said order has been complied with by him. At the same time, it was directed that SSP Sheikhupura should appear before this Court on 3-5-1994, so that the statements of the police officers should be recorded in his presence.

2. On 3-5-1994, SSP Sheikhupura appeared. He sought time to go through the file and assured this Court that he would take action against the police officer, if he comes to the conclusion that he has misconducted himself. The case was adjourned to 10-5-1994.

3. Today, the learned counsel for the Station instructions from the police officer states that the SSP has issued show cause notice to Arif Ali, SI for taking departmental legal action against him.

However, the matter is still under inquiry, In the circumstances, the case is adjourned to 4-6-1994.

With the direction that by that time, the SSP Sheikhupura should submit a comprehensive report what action he has taken against the delinquent police officer(s).
