2. S.I. Muhammad Ashraf, Incharge Police Post, People's Colony, Gujranwala, states that Iqrar A.I alias Mona was arrested on 4-6-1995 in pursuance of F:I.R. No.159 of 1995 dated 25-5-1995 under section 458/380, P.P.C. Registered at Police Station, People's Colony, Gujranwala, vide Rappat No.7 dated 4-6-1995.
3. According to the report of the bailiff Iqrar A.I alias Mona is not nominated as an accused person in the aforesaid F.I.R. No.159 of 1995. This factual position is not controverted by police officer.
4. Resultantly this habeas corpus petition is controverted into a bail petition. Iqrar A.I alias Mona is granted bail for a period of ten days to enable him to move a competent Court at Gujranwala provided he furnishes bail bond in the sum of Rs.25,000 with one surety in the like amount to the satisfaction of A.C./Duty Magistrate, Gujranwala.
5. In case Iqrar A.I alias Mona moves a petition for bail within ten days before the competent Court at Gujranwala, the said Court shall decide his bail petition on merits. .
