' Zaheer Ahmed petitioner through this petition under section 497, Cr.P.C. Seeks his post-arrest bail being accused in case F.I.R. No,150, dated 20-12-1993 registered under section 302/34, P.P.C. With Police, Station Langrana.
2. According to F.I.R. The allegation against the petitioner is that he alongwith his co-accused armed with .12 bore guns attacked upon Jehangir deceased and after that they went in their own house and committed the murder of their sister Mst. Sahib Bibi.
3. Learned counsel for the petitioner contended that the petitioner acted under sudden and grave provocation, therefore, the case does not fall under section 302, P.P.C. Further, contended that there is a lot of difference between the medical report and that of statement of witnesses and the F.I.R., therefore, this is a case of further inquiry.
4. Learned counsel for the State opposed the petition.
5. I have heard the arguments of learned counsel for the parties at length and have perused the record with their able assistance. The petitioner is a young man of 22 years and has committed the offence under sudden and grave provocation. The petitioner being custodian of honour of his sister committed the crime. In the peculiar facts and circumstances of this case, I grant bail to the petitioner subject to his furnishing bail bonds in the sum of Rs,1,00,000 with two sureties in the like amount to the satisfaction of A.C./Duty Magistrate, Chiniot.
