' Miscellaneous Application No, 1686 of 1989: Mr. Nasimuddin learned counsel appearing for the accused has contended that the accused is a respectable businessman and has remained in custody for a long time. He has further contended that the entire property belonging to accused has already been seized by F.IA. People. That the accused is prepared to submit account books before the State Bank within seven days from the date of his release on bail. He has further contended that the accused undertakes not to leave the country till the final disposal of this case.
' Mr. Abdullah Chandio learned counsel appearing for the State Bank of Pakistan has opposed the grant of bail to the accused on the ground that his earlier bail application was dismissed on merits on. 21-104989. That the accused is likely to abscond if he is granted bail.
I have considered the contentions of the learned counsel. It is an admitted position that the accused is a businessm an and his entire property standing in his name has been seized by F.IA.
People. I have been assured by Mr. Nasimuddin that the Passports and Identity Card of the accused have been kept in the Court of Sessions Judge, Karachi (East) which shall not be released or handed over to the accused without further orders from this Court. The accused shall submit account books before the State Bank within seven days from the date of his release on bail.
However, in this connection F.IA. Cell is directed to cooperate with the accused in submitting account books before the State Bank. The accused has further undertaken to settle the matter with the investoRs, ' In view of the above fact, I direct that the applicant shall be released on bail on furnishing two sureties each in the sum of Rs,2,00,000 (Rupees two lacs) and P.R. Bond in the like amount to the satisfaction of Nazir of this Court.
1. Miscellaneous Application No,1685 of 1989,: Exemption allowed subject to all just exceptions.
2. Miscellaneous Application No,312 of 1990: By consent MA. Tatari, Inspector, F.IA. Is allowed to file his affidavit-in-evidence in respect of cases pending against the accused before this Court.
3. Miscellaneous Application No,316 of 1990: In view of the orders passed on Miscellaneous Application No,1685 of 1989, this application has become infructuous and is accordingly dismissed.
' The F.I.A. Agency is directed to furnish list of property belonging to the accused and seized by them.
' The accused is further directed to submit list of his property which stands in the name of different persons as Benami.
