ARIF IQBAL H. BHATTI, J.- Sh Muhammad Arif accused/petitioner has applied for pre-arrest bail directly in this Court. The petitioner has earlier filed writ-petition No. 69 of 1996. Alleging that SHO.
P.S.Rail Bazar. Faisalabad was detaining petitioner's father Abdul Majeed illegally. The petitioner's father could not be recovered by the Bailiff. The SHO submitted his report, wherein he reported that Muhammad Arif petitioner was required in case: FIR No. 203/95. Offence u/S. 302 PPC. P.S.Rail Bazar, Faisalabad. The petitioner was allowed interim bail and was directed to join the investigation. The investigation is complete.
2. The FIR in the case was lodged by Irfan Ahmed, who alleged that on 10.10.1995 at 11.30 a.m, his father was coming in a car towards their shop situated Raja Cloth Market, Faisalabad. The car was being driven by Ghulam Ahmed driver, who stopped the same at some distance. Ghulam Rasool alighted from the car and started walking towards the shop. When he reached near Chohan Plaza, some unknown person fired a pistol, hitting Ghulam Rasool on his chest and he fell down. Ghulam Ahmad driver, informed the complainant in the nearby shop. Ghulam Rasool was taken to the hospital, where he succumbed to the injuries. The complainant suspected Muhammad Afzal son of Haji Muhammad Anwar. Muhammad Afzal son of Haji Muhammad Iqbal. Muhammad Hafiz, Ch. Muhammad Iqbal and Muhammad Riaz to be involved in the case, as the deceased owed different amount to these five persons and they use give threats to the deceased. The only evidence produced against the petitioner is of extra-judicial confession, made by the accused before a witness after one-and-a-half month. Irfan complainant sworn an affidavit exonerating the petitioner.
3. The complainant is present in the Court alongwith his counsel. He states that the petitioner is not involved in the case, ln view of the these factors, the petitioner's case requires further inquiry- His interim bail is. Therefore, confirmed. He shall furnish fresh bail-bonds in the sum of Rs. 50.000/- with two sureties each in the like amount to the satisfaction of A.C. Faisalabad.
