1. ' The applicant is an Assistant Director, F.I.A. Crime Branch, Karachi and nowadays he is under suspension. According to prosecution, the applicant in-between the night of 5/6 October, 1994 had caused injuries to his wife Mst. Abida by a Cricket Bat and three out of four injuries were found Shajjah-i-Khafifah. Injured Abida, in her statement recorded under section 161, Cr.P.C., stated that she was caused injuries by the applicant on 5-10-1994 about at 8-30 p.m. Interim bail before arrest was granted to the applicant by this Court on 7-12-1994.
2. In this case medical evidence is in conflict with ocular version. The injured was examined by the Doctor on 7-10-1994 and the age of injuries at the time of examination was found between 2 to 4 hours, whereas as per statement of the injured referred to above it should have been more than 30 hours. Learned counsel for the applicant submitted that the injured did not appear before the Medical Board comprising of Four Doctors, which was constituted for her reexamination.

' Accordingly, for the reasons given in the interim bail order, and the fact that the medical evidence is in conflict with the ocular version, the interim to the applicant on 7-12-1994 is confirmed on the same terms and conditions with a direction to him to join investigation as when he is required to do so.
