ORDER CHAUDHARY IFFTIKHAR HUSSAIN, J.- Petitioner is accused in case FIR No. 31, dated 9.4.1996 for offence' under Section 392 PPC read with section 17 Offences Against Property (Enforcement of Hudood) Ordinance, 1979. The case was registered on the report of Account Officer of M/s. Pioneer Cement. According to complainant he alongwith other officials of the Company were proceeding to Habib Bank Ltd., New Garden Town, Lahore, having with them Rs.30,67,100/- when the vehicle was hijacked at gun point.
2. In the investigation conducted later petitioner was found to be one of the accused who had planned the heist and was arrested.
3. The petitioner has applied for grant of bail to him. Learned counsel for the petitioner submitted that the petitioner did not play any role in the actual incident and allegation against him was that petitioner alongwith others was to slop the vehicle near New Campus and other that no other role was assigned to the petitioner in the, whole episode. It was submitted that co-accused of the petitioner- Sarfraz, who allegedly had played a similar role in the incident was allowed bail earlier by this Court. Learned counsel for the State opposed the grant of bail to the petitioner.
4. Admittedly the petitioner had not played any active role in hijacking the cash van and that job was done, by co-accused who are still at large. The petitioner is alleged to have conspired with his co-accused or had provided them information about the transportation of cash. Co-accused of the petitioner having played a similar role in the incident was granted bail earlier. The petitioner is, as such allowed bail on the same considerations. The. Petitioner may be released from custody subject to furnishing bail bonds in the sum of Rs.50,000/- with two sureties each in the like amount to the satisfaction of trial Court.
