ORDER

' Fayyaz Ahmad, the detenu, has been produced by the bailiff who has also submitted his report, dated 21-9-1994 which is placed on record. According to the report, the detenu was not available in the premises of the police station when he reached there at about 7 p.m. On 20-9-1994. However, when the bailiff was leaving the police station round about 7-15 p.m. Fayyaz Ahmad, detenu, jumped into the compound of the police station. On questioning he stated that police was refusing him entry into the police station through door, presumably on account of presence of the bailiff. He, therefore, jumped into the police station.

2. On questioning, the detenu has stated that he is a shopkeeper alongwith his father. He was summoned to police station 15/20 days ago, humiliated there and was allowed to leave on payment of some money. He further stated that on 17-9-1994 he was again called to the police station where he was maltreated, abused and his clothes were taken off and he was given beating.

3. Khalid Mahmood, S.H.O., respondent is present and he disputes the allegations 'made by the detenu. When questioned as to why the detenu was levelling allegations against him he had no answer. I feel satisfied that the detenu is not making a statement out of any bad intention or motive. Within the scope of present proceedings, I hereby set the detenu at liberty. He is allowed to go wherever he wants.

Keeping in view the gravity of the allegations against the Police Officer, respondent No,1, I direct the Senior Superintendent of Police to hold an inquiry into the allegations of the detenu as reproduced in this order, a copy of which be transmitted to S.S.P. He is further directed to send a report to this Court within 10 days for perusal. The S.S.P. May also consider taking appropriate action against the present Police Officer.
