An application has been filed by the petitioner under Section 249-A Cr.P.C'on 12.10.1993 for his acquittal which has not been disposed of by the learned Trial Court. Feeling aggrieved he has invoked the extraordinary jurisdiction of this Court under Section 561-A Cr.P.C, for quashment of the proceedings.

2. My view is that after the submission of the challan and during the pendency of the application filed under Section 249-A Cr.P.C; this application for the quashment of the proceedings is not maintainable.

3. However, it is the right of the petitioner to get disposed of theapplication filed by him under Section 249-A Cr.P.C, either way within a reasonable time. The learned Trial Court is directed to dispose of the aforesaid application, if pending, within a period of 60 days from today either way without feeling prejudiced by this order.

4. With my aforesaid observation this petition stands disposed of.
