ORDER

' The prosecution case is that Muhammad Safdar Satti gave 200 pounds to Hassan Din complainant (money changer) for exchange. The complainant suspected them to be fake.

Consequently, he with the help of Muhammad Bashir and Anjum Pervaiz caught hold of him and recovered 48 pounds from his pocket and thereafter took him to the police station. A case under section 489/B, P.P.C. Was registered against him at Police Station Ganj Mandi.

2. Bail is urged on the grounds that the case is based on false allegations and despite the expiry of the period of about four months, the challan has not been submitted in Court. Furthermore that Hassan Din complainant, Anjum Pervaiz and Muhammad Bashir mentioned in the F.I.R. As eye- witnesses have sworn affidavits exonerating the petitioner of the charge.

3. In the circumstances narrated above, it appears to be a case of further inquiry. Accordingly, I admit the petitioner to bail in the sum of Rs,20,000 with two sureties in the like amount to the satisfaction of Assistant Commissioner/Duty Magistrate, Rawalpindi.
