' The petitioner alongwith Qasim and Liaqat is accused of having killed three persons by firing indiscriminately with .12 bore gun. Case F.I.R. No,136/93, dated 9-4-1993 at ' Police Station Saddar Arifwala, under section 302/34, P.P.C. Is in regard to that occurrence. After investigation the challan has been submitted. The case is in progress in the Court of Additional Sessions Judge, Sahiwal, where the next date is 19-12-1994 for prosecution evidence. The bail plea has been turned down by the trial Court on 20-10-1994. The order records the complete history of the case and shows that whenever case is fixed for prosecution evidence, it is adjourned on account of one or the other reason attributable to the accused.

In support of this bail application, the learned counsel has submitted that no specific role has been attributed to the petitioner, that the prosecution case is full of dramatics and that no recovery had been effected from the petitioner. As the trial is in progress, all these pleas for grant of bail are invalid. Even otherwise a bare perusal of the F.I.R. Shows that the petitioner has been alleged to be firing at the deceased with his .12 bore gun.
3. This petition is frivolous and has no merit at all, which is hereby dismissed.
