' Muhammad Latif son of Dewan Ali has applied for post-arrest bail in case F.I.R. No,172, dated 7-8- 1993 registered under section 420/471/468, P.P.C. On the complaint of Additional Deputy Commissioner (General)/ Deputy Settlement Commissioner, Khushab at Police Station Jauharabad. The petitioner was working as Naib-Sadar Kanungo in the office of Deputy Settlement Commissioner, Jauharabad, District Khushab. Muhammad Jaffar father of Tariq Mahmood was allotted Shop No,454 in Khushab City vide P.T.O. No,30/650 issued in 1969 by the Deputy Settlement Commissioner. He was also issued P.T.D. On 9-5-1969. Muhammad Jaffar had rented out his shop to Ata Muhammad, co-accused, and proceeded abroad. Ata Muhammad paid rent for some time and thereafter he stopped the same. Tariq Mahmood made inquiries and found that an entry on 4- 9-1961 was made on the P.T.O. Of the aforesaid property to the effect that Muhammad Jaffer, the original allottee, had surrendered his rights over the property in favour of Habibullah, who sold the property to Ata Muhammad, co-accused through his General Attorney Muhammad Nazir. Tariq Mahmood submitted an application to Deputy Commissioner, Khushab, who entrusted the inquiry to the A.D.C.(G)/Deputy Settlement Commissioner, Khushab and thereafter on his complaint the case was registered.
2. It is contended that none of the witnesses had witnessed the petitioner making the alleged entries as well as tampering with the record. Neither his signatures nor handwriting was sent to the Expert for comparison. The petitioner is in the jail and the offences for which he is charged, do not fall under the prohibitory clause. The challan has been submitted in the trial Court.
3. Without expressing any opinion on the merits of the case, the petitioner is admitted to bail subject to his furnishing a bond in the sum of Rs,50,000 with two sureties, each in the like amount,
