ORDER

FAIAK SHER, J. - Post arrest bail is being sought in the case registered vide FIR No.48 of 2.3.1996 under Sections 302/324/337- D/148/149 PPC at Police Station, Saddar Sialkot, inter alia, reporting the murder and murderous assault of the complainant's sons Murtaza and Shahbaz Ahmed respectively by an unlawful assembly comprising the petitioner and 4-others, Muhammad Waris caused stab wound on the deceased's back whereupon he collapsed on the ground at which posture Muhammad Ilyas supplemented likewise injury on his left ancle; Garhra Sheikh and Baqir stab wounds on his left thigh; petitioner pistol shot wound on Shahbaz Ahmed injured right thigh to whom Waris caused stab wound, at his ancle around 3 p.m. Over multifacet irritance including materimonial estranagement.

Contending that no injury to the deceased has been ascribed to the petitioner while the injuries attributed to the PWs are belied by the medical evidence for there being only one inlet firearm wound the second one being the exit thereof, non-recover of any crime empty too contradicts the ocular account who being alien to the motive has already suffered one year's internment without even commencement of the trial and admittedly, is no more required by the investigating agency; which has been opposted by the learned counsel appearing on behalf of the complainant as well as the State reiterating the prosecution story without dislodging the contentions urged, persuaded whereby the petitioner is allowed bail upon furnishing bond in the sum of Rs.50,000/- with two sureties each in the like amount to the satisfaction of the trial Court.
