' The learned Additional Sessions Judge, Burewala, Pirzada Ata Mohyud-Din, has submitted his comments, which have been perused. Emphatically, he has refuted the allegations levelled against him by the complainant, whereas the learned counsel for the complainant has drawn the attention of the Court to the fact that Muhammad Aslam father of Muhammad Zahid, one of the accused, has recently sold away his landed property. Muhammad Aslam aforesaid has sworn and submitted an affidavit to the effect that he has made use of the sale proceeds in purchasing a commercial and a residential plot on 7-4-1994 (through Mutation No,581 and 582). It has also been pointed out by the learned counsel for the accused that the prosecution, at the instance of the complainant in the case, has wilfully withheld, over a period of about 4 months, the only P.W., Liaquat Ali, who remained to be examined, although the accused have been behind the bars over a period of about three years, and on one pretext or the other the end of trial is being deferred with ulterior considerations. It is also submitted on behalf of the accused that with the income of the land sold away by Muhammad Aslam aforementioned, to Muhammad Akram Javed, he has also arranged for marriage of his son and daughter. This assertion has however, no proof in support and is apparently an incredible one, as Muhammad Aslam son Muhammad Zahid, alongwith others, continues to be in detention, at a stretch, over about three years last.
2. I would not lend ears to the aforesaid insinuation directed against the learned trial Judge. It, however, seems that the apprehension being entertained by the complainant ought to be dispelled from his mind, in order to infuse confidence and make him believe that he will get even handed justice at the hands of the trial Court. The learned counsel for the accused has not very seriously opposed the move made by the complainant for transfer of the case which case I withdraw from the Court, in which it is presently pending. It is entrusted to the learned Sessions Judge, Vehari, for disposal, within a period of 10 days from the date he receives the records of the case. The learned Additional Sessions Judge, Burewala shall immediately remit the records to the transferee Court, which shall proceed with the trial in right earnest, and defeat the delaying designs, if the same are indeed employed by any party.
3. A copy of the order shall be conveyed to both the Courts, without any amount of delay.
