ORDER

' The petitioners have applied for post-arrest bail in a case registered against them vide F.I.R. No,114, dated 21-5-1994 under section 10/11 of the Offence of Zina (Enforcement of Hudood) Ordinance VII of 1979 at Police Station Saddar, Burewala.

2. The brief facts of the case arising out of the F.I.R. Are that one Mst. Saajda Parveen the complainant, was lifted and was taken to sugarcane and maize crops and there the petitioners and one Saleem committed Zina with the said complainant and subsequently F.I.R. Was lodged on her statement.

3. It is submitted by the learned counsel for the petitioners that allegations against the petitioners are totally wrong and baseless and as a matter of fact they are innocent; that during investigation the petitioners have been declared innocent; that challan of the case has not been submitted to the Court of competent jurisdiction so far; that the petitioners are students and requests for grant of bail to the petitioners.

4. The contents are opposed by the learned State counsel.

5. I have heard the arguments and gone through the file. Admittedly the petitioners have been declared innocent by Investigating Agencies till now. The complete or incomplete challan has not been submitted to the Court so far, even after expiry of more than 8 months. This makes the case doubtful and that of further enquiry. This being the position, the petitioners are admitted to bail subject to furnishing their bail bonds in the sum of Rs,50,000 (Rupees fifty thousand only) each with one surety each in the like amount to the satisfaction of A.C./Duty Magistrate, Burewala.

6. The observations made in the above order shall not affect the merits of the case.
