' Manzoor-ul-Hassan alias Teetu petitioner being accused of case F.I.R. No,193 of 1994, dated 30-6- 1994 under section 302/109/34, P.P.C. With Police Station, Sadar, Hafizabad has approached this Court for the grant of bail after refusal of the same by the learned Sessions Judge, Hafizabad vide, order dated 11-1-1995.
2. According to F.I.R., the petitioner armed with .12 bore gun and his co-accused Muhammad Asghar with .12 bore gun Amjad with 222 bore and Maqsood alias Soodi with klashnikov came at the place of occurrence. The present petitioner made a fire which hit on the left temple of Javed Nisar.
3. It is a well-settled principle of law that the superior Courts prefer to know the views of subordinate Courts. In view of the law laid down by the Full Bench of this Court in case of Azhar Hussain and others v. Government of Punjab and others 1992 PCr.LJ 2308, let the petitioner at the first instance move the Court of competent jurisdiction, which is, Special Court constituted under Suppression of Terrorist Activities (Special Courts) Act, 1975. With this observation, this petition stands dismissed.
