ORDER

' Petitioner is involved in case F.I.R. No,50/94, dated 4-5-1994 under sections 337-A(iii)/34, 302, 324, P.P.C. Police Station Fareed Nagar, Pakpattan Sharif. In all there are four accused. One of the accused Gulzar Ahmad had been granted bail. Against him the allegation was that he raised a Lalkara. The allegation against the petitioner is that he grappled with the deceased.

2. Learned counsel for the petitioner contends that the fact whether the petitioner caught hold the deceased is a matter of further enquiry. On the contrary the learned counsel for the complainant states that the trial has already been commenced but the learned counsel is not sure about it.

3. After hearing the learned counsel for the parties I am of the opinion that this is a case of further enquiry. Without going into the merit and demerits of the case the petitioner is admitted to bail in the sum of Rs,50,000 with two sureties in the like amount to the satisfaction of the trial Court.
