ORDER

KHALID PAUL KHAWAJA, J. - Khurshid Ali alias Chitra petitioner was convicted by the learned Sessions Judge, Sargodha vide judgment dated 4.7.1992 under Section 302(b) PPC and sentenced to life imprisonment on two counts for having murdered Mansab Ali and Walayat Khan deceased.

The petitioner lodged an appeal against his conviction and sentence which is pending in this Court and has not been disposed of. He has applied through jail for the suspension of his sentence on the ground of statutory delay.

2. I have heard the learned AAG for the State and have perused the material available on record.

3. Admittedly the petitioner's appeal is pending in this Court for the last four and a half years and has not been disposed of. The delay is not due to him. He, therefore, is entitled to the suspension of sentence and grant of bail under Section 426(1-A(c) Cr.P.C. Accordingly this application is allowed and he is allowed bail in the sum of Rs. 1,00,000/- with one surety in the like amount to the satisfaction pi the learned trial Court The bail bonds after attestation shall be sent to this Court. The C.M. is disposed of.
