1. ORDER TANVIR AHMAD KHAN, J.- The petitioners secured a loan of Rs. 4 lacs from respondent No. 1 Small Business Finance Corporation which was to be paid through installments spread over seven year the first installment according to the learned counsel was paid on 26-12-1995. Thereafter for certain business problems the petitioners could not keep up the payments. A notice was received by them on 23-11-1996 calling upon them to pay Rs. 5,14,832/-.
2. It is petitioners' case that since then they have been approaching the respondent to settle the account but till date the needful has not been done. The present writ petition has now been filed as the petitioners apprehend arrest in view' of the new's item published on 11-5-1997 in daily Jung Lahore. Learned counsel has stated in categorical terms that the petitioners are ready and willing to dear their whole liability provided an opportunity for the same is made available to them.
3. I have considered the contentions. In view of the categorical assurance of the learned counsel that the petitioners are ready to liquidate their entire liability, I dispose of this writ petition with the direction to the petitioners to approach respondent No. 1 Manager Small Business Finance Corporation, Lahore on 21-5-1997 who in turn is directed to consider their case sympathetically. He shall show them the statement of accounts arid determine the liability in accordance with law and rules read with the terms of the agreement. Till determination which of course would be made expeditiously the petitioner shall not be harassed. It i's made clear to the learned counsel that if after determination of the liability in accordance with law and rules the petitioners fail in honouring their commitment the respondents in that eventuality would be well within their right to initiate
