ORDER IJAZ NISAR, J.- Javed Iqbal Butt petitioner along with fifteen others is charged with offences under Sections 353, 324 PPC read with Sec. 6 (VII-) 78 Gambling Act, per F.I.R. No. 352, dated 30-11-91 P.S. Kotwali, Sialkot.
2. It is alleged that on receipt of secret information that a rest house was being used for gambling, a raid was conducted under the supervision of a Magistrate of Sialkot. On seeing the Police Party, the persons present there decamped leaving cash amounting to Rs. 39,000/- and seven wrist watches worth Rs. 15,000/-. Javed Iqbal Butt petitioner is alleged to have fired ineffectively at the raiding party.
3. Bail is sought on the ground that the case is based on false allegations and further that all the co-accused of the petitioner are on bail.
4. Learned counsel appearing on behalf bf the State has opposed the grant of bail to the petitioner on the ground that he had absconded after the occurrence.
5. It is contended that the petitioner's involvement in the case is lor mala fide reasons u.s Faruq Iqbal brother of the petitioner had filed a writ petition in the High Court against the Police. The petitioner is stated to be a serving Guard in the Pakistan Railways.
Since no one was allegedly injured in the occurrence and all the co-accused of the petitioner are on bail, I admit the petitioner to bail in the sum of Rs. Twenty-five thousand with two sureties in the like amount to the satisfaction of the learned Ilaqa Magistrate. Copy dasti.
