This is an application for the grant of bail to Jamshed Ali. He alongwith four others stands charged with the murder of Muhammad Arshad, taking place on 22-3-1993. The fatal injuries are attributed to his son Qaisar Jamshed. The allegation against the petitioner is that the murder was committed with his conspiracy.
2. It is stated that initially the petitioner was granted bail but subsequently on the application of the complainant his bail was cancelled on the ground that he was suborning the witnesses.
3. It is contended that in the main case he was declared innocent and placed at the mercy of the Court because he was not alleged to be present on the spot at the relevant time.
4. I have perused the order of the learned Sessions Court. The main ground which weighed with the learned Additional Sessions Judge in cancelling the petitioner's bail was that his co-accused Mustansar Ali had absented himself from the Court with his connivance.
5. The petitioner cannot be held responsible for the absence of his co-accused. Keeping in view his part in the occurrence in question and the result of the investigation, I feel persuaded to grant bail to him. I order I D accordingly. He shall be released on furnishing surety bonds in the sum of Rs, twenty-five thousand with two sureties in the like amount to the satisfaction of the learned trial Court. revisions by the competent authorities.
