Iqbal son of Babu has filed this revision petition to challenge the validity of order, dated 15-11-1994 passed by learned Additional Sessions Judge, Lahore whereby the surety amount to the tune of Rs,10,000 was forfeited and the petitioner was directed to deposit the said amount into the Government Treasury.
2. The main ground raised in support of the petition is that the provisions of section 514, Cr.P.C. Have not been complied with.
3. I have carefully gone through the order of learned Additional Sessions Judge with the able assistance of learned counsel for the petitioner. Admittedly, Abdul Waheed for whom the petitioner stood surety belongs to a different District and as such there was no reason for the petitioner to stand surety for such a person, when he even did not know him. A certified copy of the reply to the notice by Iqbal Masih clearly indicates that he was served and there was no violation of any law, even before this Court when the learned counsel was asked to produce Abdul Waheed, he flately showed his unwillingness and categorically submitted that he is not aware of where about of said Abdul Waheed. In these circumstances, I find no illegality in the impugned order of learned Additional Sessions Judge. There is, thus, no force in this revision petition which is hereby dismissed.
