1. ORDERSHARIF HUSSAIN BOKHARI, J- This petition for bail has been presented on behalf of Inayat and Ghulam Murtaza, who were sentenced for 14 years' R.I. Under section 394/397/34 PPC.2. The appeal was admitted to regular hearing on 2.11.1993 and is still pending in this Court. The sentence of Khan Muhammad convict was suspended on 7.11.1994 but the sentence with regard to the present petitioners was not suspended.3. Learned counsel for the petitioner is seeking suspension of the sentence on statutory ground under the provision of section 426(1-A)(c) Cr.P.C which states" that if the appeal of a convict, whose period of imprisonment is for life or exceeds 7 years, has not been decided within a period of two years of the conviction, the order appealed against be suspended and, also, if he is in confinement, then he be released. As observed, the petitioners were convicted on 13.6.1993 by Mian Jalal- ud-Din Akbar, learned Addl. Sessions Judge, Faisalabad. Appeal against the sentence and conviction was admitted by a learned Judge of this Court on 2.11.1993. The appeal is still pending, although more than two years have elapsed.Keeping in view the provision of section 426(1 -A)(c) of the Code of Criminal Procedure, the sentence of the petitioners is suspended. They shall be released subject to their furnishing bail bonds in the sum of Rs.50,000/- each with two sureties each in the like amount to the satisfaction of A.C., Faisalabad. revisions by the competent authorities.
