IFTIKHAR HUSSAIN CHAUDHRY, J. - Petitioner is one case FIR No. 11 dated 15-1-1996, u/s 302I379I\48I\49I\09 PPC Police Station Sadar Farooqabad District Sheikhupura.
2. The allegations against, the petitioner and his co-accused are that they while carrying fire-arms committed murder of Muhammad Ashiq.
3. Bail has been sought for on behalf of the petitioner on the ground that he was aged' seventy-one years and no specific role was attributed to him and he was also found innocent during the investigation and the police found that he was present at his dera when the occurrence took- place. The police functionary present with record has supported the contention made on behalf of the petitioner.
4. Petitioner is an aged person and was statingly armed with a 12- bore gun and allegedly had fired at the deceased. Pellets have not been recovered from the dead-body of the deceased and petitioner was also found to be present elsewhere when the alleged occurrence took place.
Petitioner is, as such, allowed bail in the sum of Rs. 30,000/- with one surety in the like amount to the satisfaction of trial Court.
