ORDERRASHID AZIZ KHAN, J.- Petitioner seeks bail in a case registered with Police Station Ravi Road, Lahore, for an offence under sections 307/148/149 PPC, vide FIR dated 26-7-1989. Petitioner was allowed bail on 1-1-1990. Thereafter petitioner failed to appear. The challan was submitted against him on 3-1-1993. On the same day proceedings under sections 87/88 Cr.P.C, for declaring him proclaimed offender were initiated. Petitioner was ultimately arrested in April, 1994.
It was contended by learned counsel for the petitioner that the petitioner after obtaining bail went abroad for employment therefore could not appear. Submits that the petitioner being the only bread-winner had to go abroad to support a large family.
2. I have heard the learned counsel at length and gone through the file. Petitioner after obtaining bail remained absconder for about for years. He was aware about the registration of case against him yet did not appear. Petitioner was allowed bail but the concession was misused by him. He is not entitled to the discretionary relief. Petition fails which is dismissed.
