ORDERRASHID AZIZ KHAN, J.- Ghulam Muhammad and Munawar petitioners seek suspension of sentence. They were tried and convicted by Judicial Magistrate Section 30. Jhang on .20-8-1995 for offences under sections 307. 452, 148/ 149 PPC. Each of them was sentenced under section 307 PPC to five year's R.1, with a fine of Rs. 20.000/-. Or in default of payment of fine undergo further S.I. For two years. Under section 452 PPC they were sentenced to one year's R.I. Each.

It was contended by learned counsel for the petitioners that ever since their conviction the petitioners are behind the bars and they had been in custody for some time even during trial and in such circumstances they have already undergone more than a year of their conviction and sentence. Submitted that on the application of the petitioners it was directed that the appeal be heard within one month but the appeal has not been heard in spite of the fact that it has been more than four months since the passing of the said order., Arguments were resisted.
3. I have heard the learned counsel and gone through the file. The petitioners were convicted to five year's R.I. On 20-8-1995. There is no likelihood of the appeal being heard in the near future because of summer vacations. In these circumstances, the application is accepted; their sentences are suspended provided each of them furnishes security in the sum of Rs. 50.000/- (Rupees fifty' thousand only) with two sureties, each in the like amount to the satisfaction of the trial Cour
