Dr. Muhammad Nasrullah petitioner passed his final M.B.B.S. Examination during the month of February, 1994. He joined Nishtar Medical College, Multan as House Surgeon with effect from 28-3- 1994. The Principal, Nishtar Medical College, Multan/respondent No.4 invited applications for Postgraduate Diploma Courses for the Session 1995-96 through Daily Nawa-i---Waqt, Multan dated 16-2-1995. The applications were to be submitted till 28-2-1995 and the terms 'and conditions 'were mentioned in the relevant application forms. '
Dr. Muhammad Nasrullah petitioner applied for the Postgraduate Diploma Course in Opthalmology Department which was entertained: He was selected for the Course vide Letter No.4518-20, dated 14-3-1995. However, vide Letter No.5612 dated 30-3-1995 his admission in the Postgraduate Diploma Course has been cancelled after the careful scrutiny of the documents submitted by him alongwith his application. Feeling aggrieved Dr. Muhammad Nasrullah petitioner has filed this writ petition getting declared the order dated 30-3-1995 of cancellation of his admission as illegal. He has prayed that the respondents may be directed to allow him to join the Diploma Course in Opthalmology Department after receiving the College fee and other dues.
2. I have heard the preliminary arguments. The main contention of the learned counsel for the petitioner is that after granting 'the permission in the matter vide order dated 14-3-1995 the admission could not be cancelled on the basis of order, dated 30-3-1995 which was passed without hearing the petitioner. Annexure-A is a photostat of the application form for admission to the Diploma Course submitted by Dr. Muhammad Nasrullah. A perusal of the same has made out that the requirement was that at least one year House Job had been performed by the applicant/candidate on the last date of making of the application in the matter which was 28-2- 1995. The admitted position is that Dr. Muhammad Nasrullah started his House Job on 28-3-1994 and thus had not completed the House Job of one year on 28-2-1995. It seems that due to inadvertence he was granted the permission and thereafter through strict scrutiny his name was correctly eclipsed. The period of one year had not to be computed with effect from the start of the classes. The said period of one year should have been completed- on or before 28-2-1995 which was the last date for making the application in the matter. Keeping in view this aspect of the dispute the order passed by the Principal, Nishtar Medical College, Multan/respondent No.4 is correct and legal to which no exception can be taken. Dr. Muhammad Nasrullah petitioner was not competent/qualified to make the application till 28-2-1995 to join the said Diploma Course. No Constitutional right of the petitioner has been infringed by the Principal, Nishtar Medical College, Multan and this petition has no merit even at this initial stage.
3. Finding no force in this petition I dismiss the same in limine.
