DECISION ' Heard Mr. Azmatullah, Law Officer, K.T.C. For the appellant.
' This appeal is directed against the order of the Sindh Labour Court No, 1, Karachi whereby the date of birth of the respondent was fixed as being 1939 instead of 1933 for the 'purpose of retirement. The learned Labour Court has relied upon the date mentioned in the National Identity Card, E.O.B.I. Card and Certificate of Medical Superintendent, Services Hospital and Civil Surgeon, Karachi regarding age. According to all these Certificates the datt of birth of the respondent falls in the year 1939. On the other hand the appellant K.T.C. Have not been able to produce any document or basis for age of the respondent to be in the year 1933. They only depend on their record in which this age is mentioned. They say that his age was written in the bio-data furnished by the respondent but this bio-data was written by the appellant K.T.C. Superintendent and only the signature of the respondent was obtained on it.
3. Under the circumstances the date of birth as 1939 appears to be more authentic based on the above evidence. I therefore find no ground to interfere with the decision of the learned Labour Court. This appeal is accordingly dismissed in limine. revisions by the competent authorities.
