KARAMAT NAZIR BHANDARI, J.- Appellant find a constitutional petition seeking a direction to the Inspector General of Police, respondent No. 1. For transfer of the investigation of FIR No. 108/96, lodged by the appellant, to another Police Officer, not below the rank of S.P., for ensuring fair and impartial investigation. A learned Single Judge noted that the appellant himself in para No. 5 of the petition stated, that the initial investigation was conducted by the local police but thereafter it was transferred to Crimes Branch where a D.S.P., was investigating the same. The learned Judge further noted that no specific bias or malice was pointed out against any of the Investigating Officer or the Agency. It was further observed that the appellant had no vested right to have the investigation transferred from one officer to another of his own choice. The petition was dismissed in limine.

Apart from the question of maintainability of this appeal which is open to serious doubt, learned counsel has failed to satisfy us that the order of the learned Single Bench suffers from any incorrectness. The findings arrived at during the investigation do not bind the Court and at worst if the investigation results in rejection of the petitioners allegations, the appellant can still prosecute his version by filing a private complaint. In the presence of such a remedy it is unfortunate that lot of time and money is wasted in investigation of cases and getting them transferred from one to the other officer or agency.
3. We are satisfied that no interference is called for in the order of the learned Single Bench.
Resultantly, this appeal is dismissed in limine.
