ORDERKHALID PAUL KHWAJA, J.- Arshad alias Papu and Saif petitioners are behind the bars in connection with a case under Section 377 PPC read with Section 12 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979 registered at Police Station Jhal Chakian District Sargodha at the instance of Muhammad Irshad who alleged that his minor son Zubair aged 12/13 years had been subjected to sodomy by the aforesaid petitioners. According to the FIR the occurrence was witnessed by Muhammad Irshad aforesaid and his brother Mukhtar Ahmad.
2. The petitioners have applied for their bail.
3. I have heard the parties' learned counsel and have also gone through the record.
4. Zubair the victim, Muhammad Irshad the complainant and Mukhtar the thira eye witness of the occurrence have sworn affidavits to the effect that the petitioners were innocent. According to the victim and the complainant the culprits could not be identified because they had muffled their faces while according to Mukhtar Ahmad he had not witnessed the occurrence. They have appeared in Court today and have reiterated the assertions made in the affidavits. In view of the .Said affidavits the case requires further enquiry. The petitioners, therefore, are admitted to bail in the sum of Rs. 25,000/- each with one surety each in the like amount to the satisfaction of A.C/Ilaqa Magistrate Sargodha. revisions by the competent authorities.
