ORDER IJAZ NISAR, J.- Abdul Majid along with two others is charged with the murder of Rehmat Ullah deceased with a Chhuri.
2. The motive for the offence is that the deceased had picked up a quarrel with Faiz-ur-Rehman's co-accused of the petitioner. On 13.12.1993, Abdul Majid petitioner accompanied by Faiz-ur- Rehman's and Muhammad Shafique went to the house of the deceased and called him out and caught hold of him. Faiz-ur- Rehman's inflicted a Chhuri blow on him which proved fatal. While the petitioner is alleged to have ineffectively fired in the air as also to have raised Lalkara.
3. Bail is sought on the grounds that the petitioner had no nexus with the motive. It was Faiz-ur- Rehman's who is alleged to have quarrelled with the deceased. Furthermore, the petitioner is not alleged to have caused any injury to the deceased. Although he was allegedly armed with a pistol, he did not fire at the deceased.
4. In the circumstances narrated above, it appears to be a case of further inquiry. Accordingly, I admit Abdul Majid petitioner to bail in the sum of Rs. 30,000/- (rupees thirty thousand) with two sureties in the like amount to the satisfaction of Assistant Commissioner (City), Gujranwala.
