ORDER

FALAK SHER, J.- Bail is being sought in the case registered vide FIR No. 167 of 29.5.1993 under sections 302/148/149 PPC at police station Khurarianwala District Faisalabad, inter alia, alleging murder of the complainant's husband Ahmad Ali around 5 p.m. While harvesting fodder, by gun shots fired by Sabir and Mansha co-accused landing on the right upper limb who succumbed to the injuries endoute to hospital, being members of an armed un-lawful assembly, his licenced gun having been lifted away by Navid Akhtar son of the latter with a view to avenging murder of his brother Ghulam Ali couple and a quarter years ago.

Contending neither the petitioner is named in the FIR nor any overt act during currency of the reported occurrence has been attributed to him save for belated assertion nearly by 2 months of the complainant substituting the petitioner with Navid Akhtar and with the completion of the investigation is no more required by the police. Which has been opposed by the learned counsel appearing on behalf of the State reiterating the prosecution story.

3. Prima facie the contentions urged by the learned counsel for the petitioner constitute reasonable grounds for further enquiring into his involvement in the offence charged thus is allowed bail upon furnishing bond in the sum of Rs. 50,000/- with two sureties each in the like amount to the satisfaction of A.C. Faisalabad.
