FALAK SHER, J.- Bail was sought in the case registered vide FIR No. 62 of 7.4.1992 under sections 302/34/109 PPC at police station Wandho District Gujranwala alleging murder of complainant's brother Abdul Sattar by the petitioner's gun shot firing landing on his chest around 6.15 p.m. While the deceased was engaged in cutting fodder in Shaftal fields at the instance of Nasarullah co- accused with a view to avenging the reprimand administered by the complainant to the latter being surety as to his bank loan for his failure to liquidate the liability.
2. Contending belated lodging of the FIR, the venue of the occurrence has been found to be wheat fields instead of Shaftal and accidental firing while shooting birds.

With which I am not persuaded because ex facie attribution of the fatal solitary wound on vital part of the deceased constitutes sufficient ground for believing petitioner's involvement in a broad day light incident falling within the prohibition contemplated by section 497(1) Cr.P.C, renders him disentitled to the sought for concession and is accordingly hereby dismissed.
