KHALIL-UR-REHMAN RAMDAY, J.- No overt act has been attributed to Qurban Shah petitioner and the only allegation against him is that, while armed with CARBINE, he was also present at the place of occurrence at the relevant time. The i.e-arm injury caused to Rizwan Ashraf PW is attributed to Sarwar Shah accused.
2. In the circumstances, Qurban Shah petitioner is released on bail in case FIR No 163/93, P.S. Saddar Gujrat subject to his furnishing security in the sum of Rs. 25,000/- with two sureties each in the like amount to the satisfaction of A.C./Duty Magistrate, Gujrat.
