ORDERFALAK SHER, J.- Bail is being sought in the case registered vide FIR No. 54 of 20.2.1994 under sections 302/148/149 PPC at police station Sadar Sialkot alleging launching of murderous assault on the complainant's brother Muhammad Bashir by an unlawful assembly comprising the petitioner (rifle), his three brothers Ashiq Hussain, Ijaz Ahmad alias Jaggi (to as), Sarfraz Ahmad alias Sarfoo (dagger) and Muhammad Ali (empty handed) around 830 p.m. With a view to teaching him a lesson for pursuing the abduction case of his paternal niece Rehana Kausar against Sarfraz etc. On Mohammad Ali's exhortation Sarfraz inflicted two stab wounds on the deceased's back and right shoulder near the ribs, subsequently whereto he was belaboured by Ashiq Hussain and Ijaz Ahmad under ineffective firing cover being catered for by the petitioner.

Contending that save for the alleged ineffective rifle shots no active role has been ascribed to the petitioner factum whereof patently stands controverted by the alleged recovery of a crime empty being that of 12 bore gun who with the submission of challan is no more required by the Investigating Agency.3. Which has been opposed by the learned counsel appearing on behalf of the State without joining issue with the contentions urged, which prima facie constitute sufficient ground for further enquiring into petitioner's involvement in the offence charged thus is allowed bail upon furnishing bond in the sum of Rs.50,000/- with two sureties each in the like amount to the satisfaction of the trial Court.
