MIAN NAZIR AKHTAR, J.- The petitioner seeks bail in a case registered vide FIR No. 443 dated 9.10.1991 for offences u/s 382/95 P.P.C, read with Section 17 Offences against Property (Enforcement of Hadood) Ordinance No.VI of 1979 at Police Station Khudian Tehsil and District Kasur.

According to the allegations made in the FIR on 5.10.1991 some unknown persons, armed with fire arms entered the house of the complainant, threatened inmates of the house and stolen away golden ornaments, clothes and cash worth Rs. 13000/- and some other house-hold articles. The petitioner was arrested on 1.8.1993 and at this instance, ear-rings weighing half tola were recovered from a room of his house.

The recovery of the golden ear-rings prima facie does not connect the petitioner with the commission of the offence because in the FIR the ear-rings said to have been stolen were shown to be of two tolas and those recovered from the petitioner's house weighed only half tola. More-over no identification parade has taken place to connect the petitioner with the commission of the offence. The matter may requires further probe and investigation but at this stage, there are no reasonable grounds for believing that the petitioner has committed the offence((page blur))

For the foregoing discussion, I accept this petition and allow bail to the petitioner subject to his furnishing bail bond in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of A.C/Duty Magistrate, Kasur.
