SAJAD AHMAD SIPRA, J.- The Petitioner is accused of offences under Sections 324 and 394 PPC read with Section 17 of the Offences Against Property (Enforcement of Hudood) Ordinance, 1979, vide FIR No 179/91 dated 29.9.1991, registered at police station Anarkali, Lahore.
2. The learned counsel for the petitioner and the State were heard at length in respect of the contentions raised herein. It was confirmed on behalf of the State that, as contended herein, the petitioner was never subjected to identification parade and that no recovery has been effected from him. Further taking into consideration that the petitioner was stated to be stranger to the complainant herein, it is hereby observed that under such circumstances, as confirmed on behalf of the state, the case of the petitioner is duly covered by the provisions of Sub-Section (2) of Section 497 Cr.P.C. It was further confirmed on behalf of the State that the petitioner is neither a previous convict nor a hardened criminal and that he is no longer required by the police.
3. Therefore, the petitioner is hereby allowed bail in the sum of Rs. 30,000/. With two sureties in the like amount to the satisfaction of the A.C./Duty Magistrate, City Lahore. revisions by the competent authorities.
