RASHID AZIZ KHAN, J.- Petitioner seeks bail in a case registered against him with Police Station, City, 'A' Division, Kasur. The case was registered on 21- 9-1993, with the allegation that the petitioner with his two brothers owned agricultural land in Kasur. They had prepared a Housing Scheme called Garden View Housing Scheme and the petitioner Muhammad Riaz was employed by them for managing the sale. Muhammad Riaz on different occasions collected Rs.9 Lac (Rupees nine lac) as earnest money from different prospective buyers which he mis-appropriated. On questioning he could not pay money back therefore the present case.
It was contended by learned counsel for the petitioner that the case does not attract prohibitory clause, therefore, he may be allowed bail. Argued that nothing was recovered from the petitioner though he remained in police custody for fourteen days, therefore, the case becomes of further inquiry. Argued that there was no evidence whatsoever which could connect the petitioner with the occurrence. Contentions were opposed by learned counsel for the State.

I have heard the learned counsel for the petitioner and gone through the i.e. The police during investigation has recorded the statements of eight persons who had stated that they had given the earnest money to the petitioner for the sale of residential plots. Nothing has been urged before this Court to show that any of those witnesses had enmity or motive for false involvement of the petitioner. Petitioner had mis-appropriated about rupees nine lac. He is named in the FIR. There is ample evidence to connect him with the alleged offence. No ground for bail is made out. Petition fails which is dismissed.
