RAJA AFRAS1AB KHAN, J.- This application for suspension of sentences has been moved on behalf of Ghulam Abbas and Ghulam Rasool. They along with 8 others were tried for the murder of Mst.
Rashida Bibi and for murderously assaulting Mst. Raza Bibi with i.e-arms on 25.1.1988. By judgment dated 23.11.1992, the learned trial Court convicted them and their co-accused under section 148/302/149, & 324/149 PPC and sentenced them to imprisonment for life plus i.e 4/s 302/149 P.P.C, and to 2 years imprisonment under section 148 PPC. They were awarded 6 months R.I. Under Section 323/149 P.P.C.
2. Suspension of sentences is claimed on the grounds that the learned trial Court had observed that he was not inclined to accept the prosecution version of having seen the petitioners firing at the deceased and further that there were two versions of the case, one based on the police report and the other on the complaint filed by Muhammad Nawaz, lt is further stated that sentences of the co- accused similarly placed have already been suspended by this Court.
3. Following the rule of consistency, I grant the application and suspend the sentences of the petitioners on furnishing surety bonds in the sum of Rs. One lac each with two sureties in the like amount to the satisfaction of A.C. Kharian.
