1. RASHID AZIZ KHAN, J.- Petitioner seeks bail in a case registered with Police Station Allah Abad, District Kasur, for an offence under sections 324/148/149 PPC, vide FIR dated 14-4-1993. The case was got registered by Muhammad Hanif with the allegation that on 12-4-1993 at abdul 8 a.m., one Muhammad Asghar came to his dhari. He told Muhammad All at the dhari that his chaff was stolen. On the same day in the evening the first informant came to his dhari. He was informed by Muhammad Ali that he had gone to the baithak of one Liaqat Ali where Muhammad Asghar was present. Said Muhammad Ali asked that he had come to watch the place upon which they exchanged hot words and were separated. Muhammad Asghar while leaving threatened with dire consequences. On 12.4.1993, the first informant with others were present when petitioner along with his co-accused came there. Petitioner is alleged to be armed with .12 bore gun. He fired hitting on the leg of the first informant. Thereafter they ran away.
2. It was contended by learned counsel for the petitioner that only one i.e was alleged which hit the injured on non-vital part of his body. Contended that there is no allegation of any other overt act.
3. Submitted that the petitioner has been in custody since April, 1993 and he is not required for purpose of investigation anymore. Contentions were opposed by learned counsel for the State.
2. I have heard the learned counsel and gone through the i.e. Petitioner is named in the FIR. He is alleged to have fired but the injury is on the left by. There is no allegation that he tried to cause have another injury or made an attempt to re-load the gun. Petitioner is not required anymore.
4. Trial has not commenced so far. Therefore the conclusion is not insight. Petitioner is allowed bail, provided he furnishes security in the sum of Rs.20,000/- (Rupees twenty thousand only), with two sureties, each in the like amount, to the satisfaction of Assistant Commissioner /Duty Magistrate, Kasur.
