1. The petitioner, Malik Muhammad Anwar is employed as a Sanitary Inspector in the Pakistan Railways and is posted as such in Lahore Area. The petitioner was transferred from Sukkur to Lahore vide order dated 5-10-1993, Annexure `G' issued by respondent No.2, General Manager Personnel.
2. The petitioner, however, apprehending. His re-transfer from Lahore to some other place moved an application before the National Industrial Relation Commission, Lahore. The learned Senior Member of the Commission vide order dated 7-11-1993 gave an interim relief to the petitioner. The contesting respondent No.4 approached the learned Labour Court No.2 Lahore and obtained a favourable order from it damaging the predominant right of the petitioner. Attention of the Court has been drawn to the order dated 19-12-1993, Annexure `J'. Admittedly, a revision petition is competent against the impugned order passed by the learned Labour Court before the learned Labour Appellate Tribunal. It is submitted by the learned counsel that learned Chairman, Appellate Tribunal is not functioning these days on account of winter vacation. He, therefore, requests for suspension of the impugned order in the given circumstances. Notice of the petition shall issue to the respondents for 2-1-1994. Status quo in the meantime shall be maintained subject to notice.
