JUDGMENT This is an appeal against the order dated 20-2-1975 of the Commissioner for Workmen's Compensation, Lahore awarding compensation of Rs. 16,000 to Mohammad Yaqub, respondent, in respect of 100% disablement.
2. This appeal is admittedly time-barred. Alongwith the appeal an application under section 5 of the Limitation Act has been filed for the condonation of delay on the ground that the relevant tile was dealt with from ^branch to branch and from one officer to another of Pakistan Railways. It is well established that no litigant has a vested right to come to Court beyond the period of limitation. Further a litigant does not act in good faith or with due diligence if he takes it upon himself to determine the time for filing a suit, an appeal or application in disregard of the time prescribed by law. In the present case I find that the delay has occurred owing to the consideration of the matter by different branches of the Pakistan Railways. Pakistan Railways was in full control of the file and if good care had been taken there was nothing to prevent it from filing the appeal in time. If delay is condoned in such a case, it would amount to putting a premium on the departmental delays and to place the Railways in a position of advantage vis-a- vis a citizen to whom a valuable right has accrued by the lapse of time prescribed for filing the appeal.
3. In view of the above observations I reject the application for condonation of delay and dismiss the appeal in limine as barred by time. revisions by the competent authorities.
