Haziqul Khairi, J.- By consent it is ordered that the learned trial Court shall dispose of the bail application filed by the applicant before it, irrespective of the fact, whether permission to sanction as required under Section 7 of the Explosive Substance Act, 1908 has been granted by the Provincial Government or not. We are of the view that the learned trial Court had grossly erred in deferring the bail application for want of permission from the Provincial Government.
2. This bail application may be decided within a week hereof. A copy of this order may be sent directly to the learned trial Court as well as to the learned Advocate General for necessary compliance. This bail application is accordingly disposed of on the above named terms.
